The COSHH Regulations have been in force since 1989, yet a large number of businesses - primarily but not exclusively, small to medium sized enterprises - have not achieved compliance. Others, while having done so, have failed to maintain the required standards. In either case such companies - and possibly their owners or directors - could face prosecution, particularly should an employee suffer injury as a result of exposure to a hazardous substance.

GUIDANCE ON COSHH REGULATIONS: This information represents our interpretation of the Regulations describing what steps are required to achieve compliance.

Definition: Substances Hazardous To Health covered in the Regulations are primarily chemical preparations but also include hazardous by-products such as fume and dust.

Examples:
- A welding rod is not classed as a substance under the Regulations but the fume created by the welding operations is.
- A log is not considered to be a substance but the wood dust created when sawing it is.
